Google can show nude thumbnails

Google has won an appeal against a court case over its use thumbnail images in its search results.

The court ruled that Google’s use of nude thumbnail images didn’t infringe the copyright of an adult publisher.

Porn publisher Perfect 10 sued Google in 2004 alleging that the thumbnails shown in image search results violated its copyright.

Google lost the original trial, but the court of appeal reversed the decision, deciding that the images were protected by fair use.

“We conclude that the significantly transformative nature of Google’s search engine, particularly in light of its public benefit, outweighs Google’s superseding and commercial uses of the thumbnails in this case,” Judge Sandra S. Ikuta wrote.
